Terms of Service

These Terms of Service ("Terms") govern your use of Cash Out (the "App" and related services, together the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

What Cash Out is

Cash Out is a bookkeeping ledger for in-person home poker games. It records the buy-ins, cash-outs, and results that players enter and agree on among themselves, and it calculates who owes whom at the end of a session.

Cash Out is a record-keeping tool only. It does not accept, hold, transfer, escrow, process, or pay out money of any kind, it does not facilitate betting or wagering, and it is not a gambling, payment, banking, or money-transmission service. Any actual exchange of money between players happens entirely offline and directly between those players.

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service. By using the Service you represent that you meet this requirement and that you are able to form a binding contract with us.

We may suspend or terminate accounts that violate these Terms.

Content you provide

You are responsible for the information you enter — including display names, guest player names, and session details — and you represent that you have the right to enter it. You grant us a non-exclusive license to store and process that information solely to operate the Service for you and the other players in your games. We may remove content that we believe violates these Terms, but we are not obligated to monitor it.

Games, money, and settlements

The numbers in a session are entered and agreed upon by the players. Cash Out reports totals and suggested settlements based on that data, but it does not verify the numbers and is not responsible for their accuracy.

Cash Out is not a party to any game, debt, or settlement between players and is not responsible for collecting, guaranteeing, or resolving any amount shown in the App. Any disputes about money owed are solely between the players involved. You are responsible for ensuring your games comply with the laws that apply to you.

The Service is provided "as is"

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data will always be available or accurate. We may change, suspend, or discontinue any part of the Service at any time.

Limitation of liability

To the fullest extent permitted by law, Cash Out and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of money, data, profits, or goodwill, arising from or related to your use of the Service — including any dispute over money between players. To the extent liability cannot be excluded, it is limited to the greater of the amount you paid us to use the Service (if any) in the twelve months before the claim, or US $50.

Indemnification

You agree to indemnify and hold harmless Cash Out and its operators from any claims, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or of any law or the rights of a third party.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

App Store terms

The App is licensed, not sold, for use only on Apple devices you own or control, and your use is also subject to the App Store Terms of Service and Apple's standard Licensed Application End User License Agreement. Apple is not responsible for the Service and is not a party to these Terms.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you in the App. Continuing to use the Service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.
